DUI Legislation

On September 30th, 2003, Act 24 was signed into law and lowered Pennsylvania's legal limit of alcohol from .10 to .08. The new law consists of a tiered system for handling DUI enforcement and includes changes to the terms of suspension, penalties, and fines. The law in Pennsylvania prohibits being in control of a motor vehicle while having a blood alcohol concentration, or BAC, of .08% or higher, having any amount of a controlled substance in the body, or being impaired by alcohol or drugs to where it affects the person's ability to operate the vehicle safely.

DUI Penalties

The penalties for DUIs depend on a variety of factors to determine how the law views them. Some of these factors include whether it is the first offense or if there have been multiple, the level of the blood alcohol concentration, whether the driver agreed to take a chemical test, and if anyone was injured or killed.

When circumstances are more heightened, the consequences can lead to jail time, substance abuse treatment, higher fines, and license suspension.
